WP3 Activities – Legal protection of transitional waters in Greece
Abstract

In the Greek legal system there is no specific legislation for the protection of transitional waters as such. However, the general normative framework of the Greek legal order concerning environmental protection and including the constitutional provisions on the environment, applies also to transitional waters. Their protection is mainly based on legislation regarding nature conservation, protected areas management and water management. If specific regulations need be adopted, it should be based on lessons already learned in these related fields (nature conservation, water management). A concrete first step is to develop guidelines on the protection and management of transitional waters, which should be taken into account both by the Management Bodies that have been established for the protected areas and by the Administrative Organs that are responsible for the implementation of the WFD.

In Grecia il sistema legale non include una legislazione specifica per la protezione delle acque di transizione. Comunque, la normativa generale dell’ordinamento legale, concernente la protezione ambientale in Grecia, è indirizzata anche alle acque di transizione. La protezione di questi delicati ecosistemi acquatici si basa principalmente su provvedimenti legislativi riguardanti la conservazione della natura, la gestione delle aree protette e la gestione delle acque. Lì dove è necessario adottare una specifica regolamentazione, si potrebbe fare riferimento a quella già esistente in campi di interesse simili, quali quelli riguardanti la conservazione e gestione della natura. Un primo passo concreto attuabile è lo sviluppo di Linee Guida finalizzate alla protezione e gestione delle acque di transizione, in cui dovrebbero essere coinvolti sia le Strutture di Gestione che sono state istituite per le aree protette, sia gli Organi Amministrativi che sono responsabili per la implementazione della Water Framework Directive.

Megjithate, kuadri i pergjithshem normativ i rendit ligjor grek lidhur me mbrojtjen e mjedisit dhe qe perfshin dispozita kushtetuese per mjedisin, zbatohet gjiathshtu per ujrat tranzitore. Mbrojtja e tyre mbeshtetet kryesisht ne legjislacionin lidhur me ruajtjen e natyres, menaxhimin e zonave te mbrojtura dhe menaxhimin e ujrave. Ne se eshte e nevojshme te pershtaten regullore specifike, kjo duhet bazuar ne mesimet e nxjerra tashme ne keto fusha te lidhura me te (ruajtja e natyres, menaxhimi i ujerave). Nje hap i pare konkret eshte te hartohen udhezime per mbrojtjen dhe menaxhimin e ujerave tranzitore, qe duhen marre parasysh si nga Organet Menaxhuese qe jane krijuar per zonat e mbrojtura ashtu edhe nga Organet Administruese qe jane pergjegjes per zbatimin e Direktives Kuader te Ujit.

In sistemul legal Grecesc nu exista o legislatie specifica pentru protejarea apelor de tranzitie. Totodata, structura normativa generala a ordinului legal grec privind protectia mediului si includerea previziunilor constitutionale de mediu, se aplica de asemenea si aplelor de tranzitie. Protectia lor este in principal bazata pe legislatie reprezentand conservarea naturii, managementul zonelor protejate si managementul apei. Daca reguli specifice trebuiesc adoptate, ele se vor baza pe lectiile tocmai invatate in aceste domenii relatate (conservarea naturii si managementul apei). Un prim pas concret este de a elabora ghidul pentru protectia si managementul apelor de tranzitie, care trebuie sa fie in concordanta cu amandoua prin Corpul de Managementul care a fost stabilit pentru zonele protejate si prin Organele Administrative care sunt responsabile pentru implementarea WFD.

Στο Ελληνικό νομικό σύστημα δεν υπάρχει ειδική νομοθεσία για την προστασία των μεταβατικών υδάτων. Όμως, το γενικό πλαίσιο των Ελληνικών νομικών διατάξεων που αφορά την περιβαλλοντική προστασία και περιλαμβάνει τα συνταγματικά άρθρα για το περιβάλλον, ισχύει και για τα μεταβατικά νερά. Η προστασία τους βασίζεται κυρίως στην νομοθεσία που αφορά τη διατήρηση της φύσης, τη διαχείριση των προστατευόμενων περιοχών και τη διαχείριση των υδάτων. Αν υπάρξει ανάγκη να υιοθετηθούν ειδικές ρυθμίσεις, αυτές πρέπει να βασίζονται στην υπάρχουσα εμπειρία πάνω στα σχετικά αυτά θέματα (φυσική διατήρηση, διαχείριση υδάτων). Ένα πρώτο βήμα είναι να αναπτυχθούν οδηγίες για την προστασία και τη διαχείριση των μεταβατικών νερών, οι οποίες θα πρέπει να λαμβάνονται υπόψη τόσο από τους Φορείς Διαχείρισης που έχουν καταρτιστεί για τις προστατευόμενες περιοχές όσο και από τα Διοικητικά Όργανα που είναι υπεύθυνα για την υλοποίηση του WFD.
