Diritto alla cura, dovere di custodia: il binomio psichiatrico tra diritto e sicurezza sociale in Italia e Francia

Con l'Illuminismo e poi con la Rivoluzione francese, i medici avevano scoperto una vocazione umanitaria che aveva aperto le porte a una pratica della professione in cui, per la prima volta, il malato era riconosciuto come "incapace e come folle" e in cui la sua condizione comportava la limitazione dei suoi diritti ma non annullava la sua personalità giuridica. Espressione di questo contesto sociale, culturale e scientifico fu la legge del 30 giugno 1838 sugli alienati che rappresentò anche la prima consistente iniziativa giuridica a riconoscimento del diritto all'assistenza e alle cure in ambito psichiatrico. La legislazione era destinata a rimanere in vigore per oltre un secolo e mezzo, con solo alcune opportune modifiche e integrazioni. L'importanza di questa legge, inoltre, fu riconosciuta anche a livello europeo perché fece da apripista alle iniziative di altri paesi, tra cui vari stati italiani preunitari. Il saggio ricostruisce il dibattito medico e legale che ha condotto alla promulgazione della legge e come ha influenzato la legislazione del Regno di Napoli.

With the Enlightenment and then the French Revolution, doctors discovered a humanitarian vocation that opened the doors to a practice of the profession in which, for the first time, the sick person was recognised as "incapable and insane" and in which their condition entailed the limitation of their rights but did not nullify their legal personality. An expression of this social, cultural and scientific context was the law of 30 June 1838 on the mentally ill, which also represented the first substantial legal initiative recognising the right to psychiatric care and treatment. The legislation was to remain in force for over a century and a half, with only a few appropriate amendments and additions. The importance of this law was also recognised at European level because it paved the way for initiatives in other countries, including various pre-unification Italian states. The essay reconstructs the medical and legal debate that led to the enactment of the law and how it influenced the legislation of the Kingdom of Naples.
